สิทธิของผู้ประกันตนตามมาตรา 39 ของผู้ประกันตน จะสิ้นสุดลงในกรณี ต่อไปนี้ เสียชีวิต กลับเข้าเป็นผู้ประกันตนตามมาตรา 33 ลาออกจากการเป็นผู้้ประกันตน ขาดส่งเงินสมทบ 3 เดือนติดต่อกัน (กรณีนี้พบได้บ่อย) ส่งเงินสมทบไม่ครบ 9 เดือน ภายในระยะเวลา 12 เดือน (สิทธิจะสิ้นสุดลงในเดือนที่ส่งเงินสมทบไม่ครบ 9 เดือน) หากมีเหตุให้สิ้นสภาพการเป็นผู้ประกันตน ม.39 สามารถขอคืนสิทธิได้โดยติดต่อสำนักงานประกันสังคมในช่องทางที่สะดวก เพื่อขอเช็กสิทธิและสอบถามรายละเอียดในการขอคืนสิทธิได้
